Terms used in this document
- "the webmaster" meaning David McFarlane
- "the websites" meaning any website operated by the webmaster specifically those accessed by the url www.misthaven.org.uk or www.misthaven.net or any other url that provides the same content as those urls or a subset of such content
Your use of the websites signifies your agreement with the terms of service and any other rules posted on the websites. If you do not agree to the terms of service and rules then do not use the websites. Acceptance of the terms of service means that you agree to abide by the rules and terms of service but does not grant you any rights over the websites its content or the webmaster and does not impose any liability on the webmaster
The webmaster makes every reasonable effort to ensure that all material posted by the webmaster to the websites is not copyright material if you believe that any of the material on the websites is copyright and should not be being shown by the webmaster then please contact the webmaster with full details of the content and the webmaster will investigate the content.

The websites may include links to third party websites over which the webmaster has no control the webmaster makes no representations as to the accuracy or any other aspect of the information contained in such third party websites and any issues that you have with third party websites should be taken up with their respective owners
Any views or opinions expressed on the websites in the Guestbook, Comments system, Bulletin Boards or anywhere else by people other than the webmaster are those of their particular author, and not necessarily those of the webmaster or the websites If you see anything (e.g. a message) that you consider insulting, illegal, against this site's TOS or other rules, or just plain not nice, please contact the webmaster and it will be investigated and removed if needed.
IN NO EVENT shall the webmaster be liable for any direct or indirect damages or any damages whatsoever including without limitation damages for loss of use data or profits arising out of or in any way connected with the use or performance of the websites.

Terms of Usage
The websites are made available to you according to these Terms of Usage("TOS") and any other rules posted on the websites browsing and or posting to the site either in person or by some automated means constitutes your acceptance of these terms.
You use the websites at your own risk. You agree that you will be personally responsible for your use of the websites and for all of your communication and activity on the websites.
You may not use the websites to:
(a) Publish, post, distribute, or otherwise disseminate content that is harassing, defamatory, infringing, pornographic, in any way connected with gambling, obscene, invasive of personal privacy or publicity rights, or otherwise unlawful or objectionable;
(b) Threaten, harass, stalk, abuse others, or otherwise cause distress or unwanted attention to any person;
(c) Post messages on the message board or guestbook or comments system or any other area of the websites for any purpose other than personal communication;
(d) Transmit advertising, promotional materials, chain letters, pyramid schemes, or make any commercial use of the websites;
(e) Engage in any unlawful purpose, or use the websites in a manner that is contrary to any law or regulation; or
(f) Impersonate another person or the website's personnel, modify files without permission, or violate the TOS or any of the website's other posted rules.
Any messages that you post to the websites using the comments system guestbook message boards or any other method of adding content to the websites become the property of the webmaster and you grant the webmaster royalty free permission to use such messages anywhere on any of the websites in any form
Any messages that you post or cause to be posted to the websites including but not limited to comments and trackback pings that make reference to gambling or pornographic sites by name or URL or that go against any of the terms stated above will constitute advertising for which you agree to pay the webmaster the sum of 1000 pounds per message regardless of whether or not the message appears on the website
Advertising as mentioned above can be removed by the webmaster at any time and may not appear on the website at all.
The webmaster reserves the right to alter or remove any messages that you post to the websites by any method without notice or explanation you agree that the webmaster can do this without liability
The webmaster may remove the websites or alter their content and their terms of use without notice
Failure to Comply
Use of the websites whilst failing to comply with the terms above may lead to any of the following:
- Blocking of your IP address(es) and or site(s) from the websites
- Addition of your IP to a or many blacklist(s)
- Invoicing for payment of time spent dealing with any non-compliance
- Invoicing for non-payment of advertising or unsolicited promotion of any products or sites
